Hello PikaNetwork people, hope you doing well with this pandemy wich is the very known Covid-19.
Beacause of that, I decided to play in your wonderful server with my long time friend Nizarh (we play here since 06/2016) and while we were playing and speaking in our mother language, we got warned about talking Portuguese (check attachements for the details and the dialog between the staff). I am really feeling offended and attacked by this illegal action, I know it's forbiden but I have the right of speech, everyone knows that (I think).
The Minecraft EULA says:
Content:
  • not be offensive to people;
  • not be illegal or unlawful;
  • not be racist, sexist or homophobic;
  • not be bullying or abusive;
https://www.minecraft.net/en-us/realms/terms/

And this is addmited a illegal and unlawful act by the Portuguese legislation
An anti-discrimination law was published on 28 August 1999. It prohibits discriminatory practices based on race, skin colour, nationality and ethnic origin
The act above mentioned as we can see it's a discriminatory practise based on our national and ethnic origin because we are forced to not talk our language, and also, the Mojang EULA mentions too and I quote:
Content If you are going to make something available on or through our Game, it must not be offensive to people or illegal, it must be honest, and it must be your own creation. Some examples of the types of things you must not make available using our Game include: posts that include racist or homophobic language; posts that are bullying or trolling; posts that are offensive or that damage our or another person's reputation; posts that include porn or someone else's creation or image; or posts that impersonate a moderator or try to trick or exploit people.
(account.mojang.com/documents/minecraft_eula).
After this I did a bit of research on your bans list and I noticed you have warned many people for this act, and for that, I searched on some sites and I found some interesting stuff like:
What is language discrimination?

Language discrimination occurs when a person is treated differently because of her native language or other characteristics of her language skills. For example, an employee may be experiencing language discrimination if the workplace has a “speak-English-only” policy but her primary language is one other than English. She may also be the victim of language discrimination if she is treated worse than other employees because she speaks English with an accent, or if she is told she does not qualify for a position because her English is not good enough. Language discrimination may also occur if a person is denied access to businesses or government services because he or she does not speak, understand, read or write English well.

Is language discrimination illegal?
Many courts and governmental agencies consider language discrimination to be a kind of discrimination on the basis of national origin, which is prohibited by federal and California law.
(from https://legalaidatwork.org/factsheet/language-discrimination/ it's a really interesting page to read), and:
[R]ules requiring employees to speak only English in the workplace violate the law
(from https://calltherightattorney.com/20...ish-at-work-can-he-do-that-best-lawyer-reply/).

I don't have the itention to harm or make someone unconfortable by any way, I just want to expose this unrightful situation on your Network, I hope that this situation gets solved peacefully and fast with a simple dialog from both of us. If not I am forced to take this to a higher level, and I'm talking to open an inquiry with Mojang. This is not at any way, shape or form, a threat directly/indirectly to someone/anyone in this Network, it is just a call for attencion on this very delicated situation. With that said, hope wishes to all of the members from PikaNetwork and a good day!

Quoting the Rules of PikaNetwork,
Speaking in a non-English language (outside PMs)
Warning
1 Day IP-Mute
3 Days IP-Mute
1 Week IP-Mute
3 Weeks IP-Mute
Permanent IP-Mute
We highly suggest the reformulation of this rule on PikaNetwork because the Network is alive due to the high culture diversity present here. The staff should also be more diverse in terms of culture and knowledge, this means you guys should allow the staff to communicate with players in their motherlanguage, because some of them may not understand English at all. Yes, we know your server is English-based but you should not be punishing people for not speaking in your defined server language. Again as NiGUEl_ONE said we are not against anyone in this threat but yes against a rule that is trespassing the Mojang EULA.
Thank you for your reading, hopefully this gets solved ASAP.

1. A Portuguese law doesn’t affect minecraft servers out of their region, also, are you taking this so far as to quote law?
2. It isn’t racist to stop someone speaking their language.
3. This server isn’t located in California. It is European, but it is still illegal there. However, I don’t think this affects MINECRAFT SERVERS. It is mostly for workplaces.
4. Pika network is allowing you to join this server on conditions, you do not have the right to join this server. It is their server, and they can make their rules. Minecraft Eula says if you make it available, it must not be offensive. Not allowing you to speak different languages isnt offensive. If you go and say “i am offended” then everything can be offensive to different people. There is NO way that servers can keep running if they abide by that rule. Hackers can be offended that they are banned, spammers can be offended that they are muted. If the majority isn’t offended, gtfo.
5. “Rules requiring EMPLOYEES to speak only English in the WORKPLACE violate the law. You are not an employee, and this isn’t a workplace. You are a player, and this is a server.

Stop being offended over everything, and I highly doubt law affects minecraft servers.

Welcome to 2020 everyone when whatever you do you manage to offend someone.

The server is based in Europe, and as a main language is english, you can still talk in your native language in /msg or faction/island chats however speaking foreign languages in the public chat is not allowed, as a matter of fact it's not even that hard enforced rule you will most likely get a verbal warning to move to /msg before getting actually warned. This rule has been in force for over a year.
Oh yeah and Portugal laws have no effect on a minecraft server based in a different country. Everyone has the right to speak their own language however everyone in public chat should also be aware of whats going on hence why speaking foreign language in private convos or fac chats is alllowed.

Ofc the portugueses laws have no effect on this.
But for sure, I can garentee you that being punished by staff for speaking in our mother-language is pretty unlawful.

Like said before, if the staff does not take any action, we will try opening an inquiry with Mojang. Breaking some Mojang's EULA rules.

It is exactly like saying that the swearing rule hurts the freedom of expression.
Of course not! If you can read you should check the whole EULA where it says specifically this:
If you are going to make something available on or through our Game, it must not be offensive to people
from "CONTENT" https://account.mojang.com/documents/minecraft_eula
They already affirm this, you are not allowed to be offensive and swear on the server(your creation/server). So yeah the rule matches the Minecraft EULA

Ok this escalated quickly, let me clear everything you tought I said.

First:
1. A Portuguese law doesn’t affect minecraft servers out of their region, also, are you taking this so far as to quote law?
I just want to say it is illegal in some countries, if not most of them. Also if it needs to take this far I won't think twice.

Second:
2. It isn’t racist to stop someone speaking their language.
It took some time to write my thread, read better. I only mentioned TWICE the word "racist" and I used it to quote the Minecraft EULA.

Third:
3. This server isn’t located in California. It is European, but it is still illegal there. However, I don’t think this affects MINECRAFT SERVERS. It is mostly for workplaces.
I'm giving half a point because when you say:
I don’t think this affects MINECRAFT SERVERS
It clearly shows you didn't check the Minecraft EULA.

Fourth:

Theres a lot of stuff wrong there. Let me clear. You in order to start any type of Minecraft server you are forced to agree the Minecraft EULA and as I mentioned before it is discrimination.

Fifth:
5. “Rules requiring EMPLOYEES to speak only English in the WORKPLACE violate the law. You are not an employee, and this isn’t a workplace. You are a player, and this is a server.
Thats an example, the definition is and I quote:
Language discrimination occurs when a person is treated differently because of her native language or other characteristics of her language skills.

Last one:
Stop being offended over everything, and I highly doubt law affects minecraft servers.
It breaks the rules.

In conclusion, you shouldn't reply to a post without reading all of it and understanding it (it's my point of view, but of corse I can be wrong). The things you said about what I wrote are off context. And again:

I don't have the itention to harm or make someone unconfortable by any way, I just want to expose this unrightful situation on your Network, I hope that this situation gets solved peacefully and fast with a simple dialog from both of us. If not I am forced to take this to a higher level, and I'm talking to open an inquiry with Mojang. With that said I hope you understand my point of view and others too.

Alright a staff wrote a small reply, thanks by the way (it's a joke).
The swearing is offensive and abusive language and for that it's wrong and we all have the right of speech, but EULA says and I quote, again:
  • not be offensive to people;
  • not be illegal or unlawful;
  • not be racist, sexist or homophobic;
  • not be bullying or abusive;

With that said, don't forget:
I don't have the itention to harm or make someone unconfortable by any way, I just want to expose this unrightful situation on your Network, I hope that this situation gets solved peacefully and fast with a simple dialog from both of us. I didn't expect that, you say some stuff right and some wrong for a former staff member. Let me clear it for you.

First:
The server is based in Europe, and as a main language is english, you can still talk in your native language in /msg or faction/island chats however speaking foreign languages in the public chat is not allowed, as a matter of fact it's not even that hard enforced rule you will most likely get a verbal warning to move to /msg before getting actually warned. Everything right and total agreement between you and my until:
as a matter of fact it's not even that hard enforced rule you will most likely get a verbal warning to move to /msg before getting actually warned. This rule has been in force for over a year.
Check the attachement, I thought it shows the warning and no verbal one. And history I like that and didn't know that fact, thanks!

Second:
Oh yeah and Portugal laws have no effect on a minecraft server based in a different country. Everyone has the right to speak their own language however everyone in public chat should also be aware of whats going on hence why speaking foreign language in private convos or fac chats is alllowed.
Tottally agree, but you need to know that the server is played by young people from different countries and they don't any language but their mother one and Minecraft EULA says and I quote:
not be illegal or unlawful;
So, the server is played by many players around the world and for that I think you sould be in conformity about the laws in others countries. I only choose Portugal because it's where I live.

Sorry for the spam but I have to mention this:
I don't have the itention to harm or make someone unconfortable by any way, I just want to expose this unrightful situation on your Network, I hope that this situation gets solved peacefully and fast with a simple dialog from both of us. So we are forced not to speak our mother language in public chat? Excuse me, but I must say that it's disrimanatory and the rest you know, if not read my whole post, please.

You sir are the first to have a problem with this rule, you are allowed to speak your language in private conversations however for the sake of keeping the chat clean and easier moderation english is set as the primary and only language for public chats as this is a server where english is the main language used. Players that do not know english wouldn’t bother joining a server in which people speak english would they?

Gentlemens, the issue we are discussing here is not the fact we are can't speak in our mother language but yes the fact we are getting punished for it!
It's irracional, illegal and outbreaking the Mojang EULA.

Lets solve this the quick way with removing the punishment for this ancient rule.

Peace & Love from Nizarh.

The problem isn't the main language, it's the punition about talking your language, like my example.

Players that do not know english wouldn’t bother joining a server in which people speak english would they?
This phrase got me triggered. Where in the world would you think that? The Minecraft players are mostly kids playing (9-14 years old, more or less) and not all know how to formulate a english sentece right (I'm 24 and it's far from perfect), I don't know if making people not talk in public chats because their language is right...

We have the right to choose our language in public or private social space.
From Language rights

You sir are the first to have a problem with this rule
Thanks to say treat me as a "Sir", I really appreciate it but I ain't here for it I am here to say I am a fighter for my and your rights around the world and expose anything that seems any type of discrimination.

This is 100% harmless.
No it isn't, check what I wrote... I asked to read the damn thing before you reply again...
I would like to get this situation solved as soon as possible, for that I would like to talk to a admin, and not a trial/helper.

One more thing:
I don't have the itention to harm or make someone unconfortable by any way, I just want to expose this unrightful situation on your Network, I hope that this situation gets solved peacefully and fast with a simple dialog from both of us. (I edited this because "I would like to talk to a admin, and not a trial/helper" can be misleading and lead to a misinterpretation from what I said)

When you play on Pika Network, it means you agree and must obey their rules. It is stated clearly that, "Speaking in a non-English language (outside PMs) " is against the rules. The reason why they only allow English in public chat is so that everyone understands each other. You can speak in any language you would like, in
/msg, factions chat, island chat, party chat etc.
. Anything not public. Next time, read and review the rules carefully. https://pika-network.net/rules/
